The fair use doctrine is successfully invoked in cases of face-to-face instruction, critical review, parody, transformational use and in other cases. I can tell you from experience, even in apparently clear cases of fair use, there's often a good argument to the contrary. It's rather sketchy. Particularly for someone selling seeds. How do they actually know that my image is what I say it is?
Nevertheless, I got an apology from the owner of the site and they removed the picture immediately after I requested it. I've asked the mods to delete this thread. Mistakes happen. |
